Magnolia Spaces Rules & Regulations

Rules and regulations are based on common sense, common courtesy and in the best interest of Magnolia Spaces and residents of Magnolia Spaces. If you have any questions, please check with the office team. These and other Rules may be changed without notice.

Office Hours: there is no physical office for Magnolia Spaces. Check-in procedures and helpful information will be communicated after the initial payment is received. Virtual Office Hours: 9:00 AM- 5:00 PM Monday through Friday.

Check-In/Out: Check-in is at 1:00 pm and Check Out is at 11:00 am. No arrival after 9 PM
Quiet Hours: 11:00 PM- 7:00 AM.

1. Space Fees and any other payments are due and payable each month as noted in Section 111 of the Terms and conditions. Cash, cashier’s check or money order will be immediately required to recover a returned check and personal checks will not be accepted for any future payments.
2. The common back yard area of the resort is strictly NO SMOKING. Smoking is allowed in your reserved area, excluding the communal back yard. Cigarette butts must be extinguished and discarded in resident provided fire safe container.
3. One (1) RV and two (2) vehicles are allowed per site. Vehicles that are not registered or in disrepair will not be allowed. Disrepair condition is at the sole discretion of the owner and manager of Magnolia Spaces.
4. RVs should be in good repair and not older than ten (10) years. Units more than ten years old are subject to inspection and must be pre-approved by Magnolia Spaces Management via photos. If RV arrives at Park and isn’t as appears in submitted photos, then the Park reserves the right to reject the reservation.
5. The site is for your RV and up to two motor vehicles. Additional vehicles must be approved in writing by management. The RV is to be located on site so that a car or truck may be parked on the drive in front of your RV. No trailers, boats or other towed apparatus are allowed to be on property without management written (email) approval.
6. You may park in designated areas only. Parking on or parallel with streets, including Plasuela street, is not allowed. No parking on any grass areas.
7. Utility trailers, tent trailers, tent camping, pop-up campers, converted horse trailers, boats, trampolines, and basketball goals are not allowed on the site.
8. No major vehicle repairs shall be made on these premises. Service work including changing oil and lubing is prohibited.
9. Space lot lines are generally from electric meter to electric meter. However, there are reflectors and markers in place designating more precise lot lines. Please do not encroach on your neighbor’s site.
10. Do not use a vacant site or parking spaces for any reason without first contacting the office.
11. If you have an RV off site for repairs, etc. please notify the office.
12. Pets - See Addendum B – Pet Policy
13. Your space must be kept neat, clean and free of boxes, litter or trash. No refrigerators, storage bins, gazebos, grill shelters, freezers, weight sets, clothes lines, etc are allowed. Contact Magnolia Spaces Management for questionable items. Do not let items accumulate under or around your unit.
14. Portable buildings or sheds are prohibited. Open air tents, or cabanas, are allowed in the middle yard areas of your licensed space
15. Tents or other temporary shelters may not be erected for more than forty-eight (48) hours.
16. No covers above RVs are permitted.
17. No wood or charcoal campfires are allowed except in the communal back yard and private back yards of spaces 1 & 5. Gas grills are permissible in your middle yard area.
18. Damage caused by you, your family or guests is YOUR responsibility.
19. Loud parties, excessive drinking, offensive language, or other unacceptable behavior by residents or their guests is not permitted. Illegal activities of any sort are strictly prohibited and will be reported to the local authorities. If we decide to call the authorities for a disturbance at your site, you will be subject to immediate eviction with no refund of prepaid rent or security deposit.
20. You are responsible for the conduct of your children and any guests; they must always be supervised by an adult resident.
21. A sprinkler system is in place to keep yards healthy. Watering cycles vary and you agree to allow watering of lawns as determined by management. Sprinkler systems operate between 2am and 5pm varying days and frequencies.
22. A sewer hose “donut” or “L” connector is required. A $125.00 clean-up fee will be charged if your RV causes a sewer back-up.
23. To take advantage of our courtesy trash pickup, place your secured trash bags in the dumpsters at the front of the property by lot 1 – Grapefruit Lane. - by 6:30am Mondays and Thursdays. You agree to follow the Town of Refugio Residential Garbage Collection policies in Addendum C of this agreement.
24. Please do not attempt to correct any problems with Magnolia Spaces facilities, notify the office
25. No unregistered, junked, unusable, unsightly or vehicles in disrepair will be allowed on the property.
26. No fireworks.
27. Open Carry of firearms is prohibited throughout Magnolia Spaces
28. All vendors need to be pre-approved by the park and carry a COI with Magnolia Spaces as an additional insured.
29. Internet access passwords are for paying guests only and should not be shared with anyone that is not a paying resident. Passwords are changed frequently, and you will be notified via email or text of any password changes.

Magnolia Spaces Rental Agreement

This RV Space Rental Agreement is entered into by and between Arete Hotel Consulting, LLC dba Magnolia Spaces, and the individual (s) listed on the Magnolia Spaces Rental Application.

This Magnolia Spaces Rental Agreement constitutes the full agreement of all parties and consists of (i) The Executed Rental Application (ii) Each of the Terms & Conditions set forth herein (iii) The Rules and Regulations now existing and hereafter promulgated and amended by Magnolia Spaces at it’s sole discretion (iv) Any and all Amendments executed by the occupant.

TERMS AND CONDITIONS
1. Magnolia Spaces is owned and operated by Arete Hotel Consulting, LLC.

2. Licensee Status: Residents, regardless of length of stay, are considered transient licensees of space.You agree that rental of space at Magnolia Spaces establishes only a licensee relationship, and not atenant relationship, which subjects you to immediate eviction if deemed appropriate by themanagement of Magnolia Spaces

3. Possession of Space: Magnolia Spaces is NOT dispossessing itself of the premises. You agree thatusage of your rented space does NOT constitute exclusive possession of your rented space.

4.Purpose: The Park rents the RV Space identified in the Rental Application (the
“Space”) to Occupant for the term identified herein. Rental of such Space shall be for the sole purposeof maintaining the recreational vehicle identified in the Rental Application (the “RV”) on the Spaceduring the term of this Agreement and for occupancy of the RV by the Permitted Occupants identifiedherein.

5.Term. The Term of this Agreement is included in Addendum A of this agreement.

6.Termination by Occupant. This Agreement shall remain in effect, and Occupant shall be liable to payrent as set forth in Amendment A of this Agreement, whether or not the occupant occupies the spaceor maintains a recreational vehicle at the space during the term. If the initial agreement is for 30 daysor more, once 30 days have passed the Occupant may terminate this Agreement with a minimum of 7days advance written notice via text or email and confirmed received by Magnolia Spaces. ANYTERMINATION OF THIS AGREEMENT BY OCCUPANT DURING THE INITIAL TERM, OR WITHOUT 7 DAYSNOTICE IF LENGTH OF STAY IS 30 DAYS OR MORE, SHALL OBLIGATE OCCUPANT TO PAY AN EARLYTERMINATION FEE OF $300 OR THE REMAINING BALANCE OF THE INITIAL RENTAL PERIOD COST,WHICHEVER IS LESS.

7.Termination by Magnolia Spaces Magnolia Spaces may terminate this Agreement for cause ifOccupant: (i) Fails to observe, perform, or honor any one or more of the terms of this Agreement, (ii)fails to observe the Rules and Regulations now existing or hereafter promulgated by the Park, or (iii)engages in conduct constituting a violation of any law, regulation or ordinance, (iv) provides any falseor misleading information in the Rental Application. Magnolia Spaces may terminate this agreement atany time, without cause, once the initial term has been satisfied.

8.Security Deposit. Any amount listed in Addendum A as a security deposit shall be paid by Occupantupon the execution of this Agreement and shall be held by the Park as security for any damage ordefault hereunder in such manner as is permitted by law. The amount of such security deposit shall berefunded to Occupant upon the termination of this Agreement subject to any deduction for damage oroutstanding charges due and owing from Occupant. The refund will be processed within 7 days afterthe occupant’s departure from Magnolia Spaces.

9. Assignment and Subletting: Lessee shall not sublet the RV Space, or any part of the Premises, or assign this agreement without Lessor’s prior, express, and written consent.

10. Payment Methods: Payment may be made through deposit into Magnolia Spaces checking account at First State Bank in Refugio, TX. Payments may also be made through use of the Cash App or Venmo payment apps. Credit or debit cards are not accepted by Magnolia Spaces.

11. Payment Terms: If a space is rented for an initial term less than 30 days, the Occupant shall pay rent, in advance, at the rate specified in Addendum A. Simultaneous with the execution of this Agreement, Occupant shall pay pro rata rent for any initial fraction of time together with any security deposit or other prepaid amounts identified in Addendum A. Thereafter, the Occupant shall pay rent in full at least 24 hours prior to any additional day’s stay if staying less than 30 days. If your stay is 30 days or more, the occupant shall pay rent in full on the 1st day of each month. All rent and any other charges shall be paid in advance, without deduction or offset of any form. A late charge may be assessed by management in the amount of $10/day (or such other amount as permitted by Texas law) whenever rent is paid more than three (1) days past due. A check return charge may be assessed by management in the amount of $40.00 whenever a check for rent or any other charge is returned unpaid from a bank or financial institution.

12. Occupancy. Occupancy of the RV and the Space shall be limited to the individuals identified in the Rental Application and no more than two (2) overnight guests, provided that total occupancy of the RV shall at no time exceed the maximum design capacity of the RV. No overnight guest otherwise permitted hereunder shall occupy the RV for more than one (1) week in any calendar month.

13. Occupant’s Property. Occupant shall be solely responsible for any damage or loss
to the RV and any other property of the Occupant and shall maintain appropriate insurance coverage at all times. The Park shall not be liable for damage to the RV or Occupant’s other property of any type, for any reason or cause whatsoever. Upon any termination, vacation or abandonment of the Park or the Space, Occupant shall promptly remove the RV and all of Occupant’s other property from the Park. In the event that the RV or any other property of Occupant is not removed within fifteen (15) days of the termination of this Agreement or Occupant’s vacation or abandonment of the Park or the Space, the Park may remove and dispose of the RV and any other property in any manner that the Park may determine in its sole discretion, without liability to Occupant. The Park shall in no case be required to comply with any law or statute regarding abandoned or unclaimed property and shall not be liable or responsible for storage or disposition of the RV or Occupant’s other property.

14. Mandatory Arbitration: Any dispute under this agreement shall be required to be resolved by binding arbitration of the parties hereto. If the parties cannot agree on an arbitrator, each party shall select one arbitrator and both arbitrators shall then select a third. The third arbitrator so selected shall arbitrate said dispute. The arbitration shall be governed by the rules of the American Arbitration Association then in force and effect.

15. Indemnification. Each Occupant shall jointly and severally indemnify, defend and
hold the Park and its members, managers, employees, agents and other representatives harmless of and from any claim, demand, loss, liability, damage or cost that any of them may incur in any way related to Occupant’s occupancy of the Space and the RV park including, without limitation, (i) any personal injury or property damage suffered or sustained by Occupant or any guest occupant, (ii) any damage to the RV park or any improvements or amenities therein, and (iii) any personal injury or property damage suffered or sustained by any other Park occupants, visitors or guests.

16. Governing Law: This agreement shall be governed by, construed, and enforced in accordance with the laws of the state of Texas.

Magnolia Spaces Pricing Information

ACCORDING TO TEXAS PENAL CODE SECTION 31:04 (b), any guest who leaves without paying for site services or who refuses to pay for site services when due is subject to criminal prosecution. We provide service hook-ups for your RV. We require full payment in advance and will prosecute any violations under the “THEFT OF SERVICES LAW”.

After the Initial Term, this Agreement shall automatically be renewed for an additional period of the same length of time as the initial agreement and shall remain in all respects subject to the terms and conditions of this Agreement.

Daily Rates

Water, Sewer, Trash Disposal and Electric are included.

Payment in Full is Required at the time to secure a contract. Cancellations 2 days or more before scheduled check in are eligible for a full refund. Payment is nonrefundable if cancelled less than 2 days prior.

Weekly Rates

Water, Sewer, Trash Disposal and Electric are included.

A Security Deposit of $100 is required to reserve a space. Cancellations 7 days or more before scheduled check in are eligible for a full refund. The Security Deposit is not refundable if cancelled less than 7 days prior to schedule arrival or if no-show on the day of arrival.

Long-term rates 30 Days or More

Discounts may be available for stays of 90 days or more. Contact Management for Discount details.

Water, Sewer, Trash Disposal and Wifi are included.

A Security Deposit of $150 is required to confirm a long-term space reservation. The Security Deposit is fully refundable if the reservation is cancelled 7 days or more before scheduled arrival. The Security Deposit is not refundable if a reservation is cancelled less than 7 days prior to scheduled arrival, or if occupant does not arrive on the date of arrival.

A $150 Electric Deposit is due the day of arrival. Electric access will be granted once the Electric Deposit is paid. The Electric Deposit, less any electric usage costs unpaid upon departure, will be refunded within 7 business days. Metered electric usage will be charged at actual usage at a rate of 0.18 cents per Kilowatt

Rent Increases

After the Initial Term, Magnolia Spaces may increase rent with 7 days’ notice for stays less than a month, and with 30 days’ notice for any stays of 30 days or more.

Magnolia Spaces Pet Policy

Special permission to keep a house pet in the Park must be obtained from Magnolia Spaces Management. A house pet is defined as a pet that spends its primary existence within the RV. Park Management reserves the right to deny approval of a pet if a proposed pet could pose a threat to the health and safety of other Guests of the Park.

A) Non-house pets (including farm animals) are prohibited under any circumstances.
B) Once you are staying at Magnolia Spaces, a pet may not be acquired without written permission from the Management.
C) If any of the rules regarding pets is violated and such violation is noted by Management or a valid complaint is made by another Guest, the owner of the pet will receive an official notice in writing stating that the right to keep a pet at Magnolia Spaces may be terminated.

The following rules must be strictly followed by all pet owners:
1) Each pet must have a current rabies certificate when checking in and remain current for the duration of your stay. Certificates need to be submitted to Management within seven (7) days of receipt of a written request for such information.
2) All pets must be registered with the office.
3) Maximum of three (3) quiet well-mannered pets are allowed per site. – DOGS: either 2 large (max. 80lbs.) or 3 small dogs (under 25lbs.) or 1 large (max. 80lbs.) and 2 small dogs (under 25lbs.) One cate can replace any dog in the above combination.
4) Pets must be on a leash when not inside the RV.
5) All pets are to be kept inside at night and are never to be left unattended.
6) Any pet running loose in the Park will be turned over to the appropriate authority. Recurring violations of this rule will lead to the loss of the privilege to maintain a pet.
7) Pets will not be allowed to cause any disturbance which might annoy neighbors, including, but not limited to, barking, growling, biting or any other unusual noises or damage. Under no condition is a pet to invade the privacy of anyone's site.
8) Pet owners are responsible at all times for their pets, including injury, destruction, and annoyances to other Guests, and Magnolia Spaces shall not be liable for any loss, damage or injury of any kind whatsoever caused by Guest’s pet.
9) Any exterior pet enclosures have to be approved by Park Management.
10) Visitors are not permitted to bring a pet into Magnolia Spaces without prior Management approval
11) The tying up of pets outside the RV and/or leaving them unattended outside is prohibited.
12) Guests are required to dispose of their pet waste on and around their site daily. If you walk your pet around the neighboring properties, you must dispose of your pet’s waste. Pet Stations are provided along the picket fence for your convenience.

VIOLATION OF THESE PET GUIDELINES is grounds for ejection from the park WITHOUT refund
